LEGISLATION​

Ohio Employers Against Health Care Hikes is urging lawmakers to oppose the following bills, all of which would drive up the cost of health care and prescription drugs for Ohio employers, reduce access to care, and endanger patients:

HB177 (CO-PAY):

imposes costly mandates on employers by forcing them to accept coupon schemes created by drug manufacturers which bait and switch consumers onto expensive brand name prescriptions and steers them away from generics. These tactics have been deemed illegal kickbacks by the federal government and are outlawed under Medicaid and Medicare plans because they give windfall profits to pharmaceutical companies and artificially inflate the costs of prescriptions.

  • For every $1 million in manufacturer coupons for brand drugs, manufacturers reap more than $20 million in profits (20:1 return).

 

  • The prices for drugs with manufacturer coupons increase faster (12-13% per year) compared to non-couponed drugs (7-8% per year).

HB130 (GOLD CARDING):

endangers patients by removing critical safety checks and balances in the prescribing process for consumer prescription drugs. This practice also exponentially increases costs to employers by allowing healthcare providers to bypass prior authorizations protocols currently in place. This legislation emboldens overprescribing and allows bad actors in the prescribing space to evade detection.

HB 156 (WHITE BAGGING): 

creates inefficiencies and inconveniences for patients by preventing mail-service for prescriptions. This legislation puts patients in danger as research indicates that mail-service pharmacies dispensed prescriptions with 23-times greater accuracy than retail pharmacies. Additionally, the legislation forces employers to pay an exorbitant markup on prescriptions filled through hospitals, at times paying 400% more than they would through mail-service for the same prescription.

SB 61 (INSULIN CAP):

inserts government-set price controls that grossly benefit pharmaceutical companies at the expense of patients and employers. This legislation proposes mandates to prevent payers from effectively managing their own drug costs and punishes the public by forcing them to pay more in health premiums and overall health care costs.
